Spain: what actually goes wrong

The setups that repeat in Spain, what the law here really says, and what to do if the police turn up. Plain, unhysterical, written for adults.

The Spanish risk is the pickpocket and the inflated bill, not violence. The old quarters of Madrid, Barcelona and Seville concentrate both, and the pattern of the bar with no visible prices repeats identically in all three. In the roadside-club areas the risk changes shape: there the problem is not what you are charged, it is that you do not know who organises what.

The law where you are standing

Spain is the largest legal grey zone in Europe. Sex work is neither legalised nor criminalised: the exchange between two adults is not an offence, but nothing regulates it either, so there are no licences, no registration and no health scheme. Pimping and any profit from another person's work is a crime, and so is paying anyone under 18. Street work is banned by municipal ordinance in most large cities, with fines that fall on the client. Proposals to criminalise buying have been debated repeatedly and, as things stand, have not become law.

Almost nothing here is exotic. The same four or five scripts run in every city in Europe, and the only reason they still work is that men who feel embarrassed do not compare notes.

Two adults in a private room is not, by itself, a police matter in most of Europe. Stay still, stay polite, do not run and do not volunteer a story. You are allowed to say you would prefer to speak with a lawyer. Do not sign a statement in a language you do not read.
